Setting up a power of attorney (POA) is an important step in planning for the future, allowing someone you trust to make decisions on your behalf just in case you’re unable to for health or other reasons. Many people wonder – how much does it cost to get this done through a solicitor?
What affects the cost of a power of attorney?
The price for a power of attorney can vary depending on a few key factors:
- Type of power of attorney: There are different types, including Lasting Power of Attorney (LPA) for health and welfare, and also for property and financial affairs. Often, clients choose to set up both.
- Complexity of your situation: If your affairs are straightforward, costs are usually lower. More complex circumstances — for example, involving trusts or multiple properties — may require additional work.
- The solicitor’s fees: Some firms charge a fixed fee, while others bill by the hour. Bates Wells and Braithwaite offer clear pricing and will explain costs upfront.
Typical costs you might expect
At Bates Wells and Braithwaite in Ipswich or Hadleigh, an LPA usually costs between £400 and £800 per document, including legal advice and assistance with the application to the Office of the Public Guardian. If you require both health and property LPAs, costs will be higher accordingly.
There are also additional fees to register the LPA with the Office of the Public Guardian (OPG) (currently £82 per document), which are paid over and above the solicitor’s fees.
Why use a solicitor?
While it is possible to create an LPA yourself, having a solicitor helps to ensure the documents are correctly prepared, reducing the risk of mistakes or delays or rejection by the OPG. Solicitors also offer advice tailored to your needs and help guide you through registration and use of the POA.
