What is Divorce Monday?

January 5, 2026

The first working Monday in January has unofficially become known as Divorce Monday – a day where family solicitors often find a peak of people reaching out for advice about divorce, separation, or mediation. And while the name sounds dramatic, there’s a very real and relatable reason behind it.

According to national data, the first quarter of the year has seen the highest number of divorce applications over the past four years. When you combine Christmas stress, financial pressure, and the intensity of spending a long period in close quarters, it’s no surprise that many people reassess their relationships once January arrives.

Why does January feel like breaking point for many couples?

Christmas is meant to be a joyful time, but it can also highlight weak spots in a relationship. If things already felt strained, the festive period may have magnified the issues. Christmas is also expensive, and financial strain is often one of the biggest contributors to relationship breakdown.

Many people also delay making any big decisions before Christmas, especially when children are involved. They don’t want to disrupt the holidays, so they wait. Once the new year begins, reality returns, and the pressure that was building over the holidays reaches a point where change needs to be made.

Why does reaching out for legal guidance matter?

It’s completely natural to feel overwhelmed or unsure about what to do next. Speaking to a family solicitor doesn’t mean you’re committing to divorce, but it will give you clarity. Understanding your rights, your options, and the practical steps ahead can help bring control at a very emotional time.

Whether you’re considering separation, mediation, or just wanting more information about how divorce works, advice early on is invaluable.
